CNA
CNA was a complex class action settlement involving people who had long term care insurance. Hilsoft Notifications wrote and designed the notices to convey the complex legal issue surrounding the settlement in plain language, so that class members, who were predominately elderly, could easily understand their rights and options under the proposed settlement. In addition, we also designed and distributed the CAFA notification to the Attorneys General and Department of Insurance Commissioners. Upon implementation of the notices and notice program, our notice expert prepared a detailed final report affidavit illustrating that 99% of the class was reached through mailed notice. The affidavit addressed and easily rebutted the objections that were made with regard to notice. When granting final approval to the settlement, the court agreed with our notice expert and overruled the objections. Ultimately, over 45% of the class filed a claim. Judicial Comments
