Expert Notice Plan Design

Hilsoft Notifications specializes in designing notice programs that satisfy due process requirements and withstand judicial scrutiny. To determine the most effective method of providing notice to the greatest practicable number of class members, we:

  • Conduct in-depth research from the communications industry’s leading research sources and proprietary research tools
  • Analyze the demographic, geographic, and behavioral characteristics of potential class members
  • Analyze the media habits of the class.
Legal noticing demands an unbiased approach and subject-matter expertise. Hilsoft Notifications delivers both.

Effective

To quantify the effectiveness of our notice programs, we calculate the reach and average frequency of exposure of the notice -- the guiding principles for notice today.

Reach is defined as the percentage of a class exposed to a notice, excluding duplication among people who may have been exposed more than once.

Frequency is the average number of times that those reached by a notice would be exposed to a notice.

Experienced

Hilsoft played a key role establishing “reach” and “frequency” calculations as the standard methods to analyze notice programs in the class action field. Previously it was common practice to simply mail notice to any available list of names, and/or publish notice in a few newspapers that may or may not have been read by class members. This left courts and professionals to question whether the class was truly notified. Today, reach and frequency calculations are the guiding principles for calculating the success of a notice program.
