Naef v. Masonite Corp., No. CV-94-4033 (Cir. Ct. Ala.) - Analyzed a notice plan submitted by an opposing expert and found that it did not effectively reach class members involved in a hardboard siding settlement. Our proposed enhancements resulted in the parties stipulating to additional media coverage and notice activity, which significantly improved the notice program targeted towards U.S. homeowners. After the Court granted final approval of the settlement, we were retained to provide an additional voluntary outreach (including television) to class members informing them of their right to file a claim and the approaching claims deadlines.
Williams v. Weyerhaeuser Co., No. CV-995787 (Cal. Super. Ct.) - Notice placements informing homeowners about a hardboard siding settlement appeared in the best-read publications in the United States, in selected daily newspapers, and on strategically chosen radio stations in key geographic areas, which were revealed after our detailed analysis of warranty claims. An objection on notice issues was addressed in our expert affidavit, and as a result, the objection was rejected and the settlement was approved. The settlement notice ruling later withstood a challenge to the California Court of Appeals in a reported decision. Judicial Comments
Gardner v. Stimson Lumber Co., No. 00-2-17966-3SEA (Wash. Super. Ct.) - In addition to placing notices in over 100 newspapers throughout the class area, we also placed notices in the leading publications among homeowners and produced a party-neutral television notice to alert class members about the settlement. To further enhance the notice program, we utilized earned media activities, trade audience related notice activities, and online notice activities.
