
Ford Explorer Cases
What started out as a California state-wide class certification notice program spiraled into a highly litigated trial. After several months of litigation, the parties eventually agreed to a four-state settlement. This complex settlement involving the rollover tendency of Ford Explorers included class members in California, Connecticut, Illinois and Texas. Each class was defined differently depending on the state, and the rights and options for class members varied. Hilsoft Notifications analyzed the different classes and determined the best notice practicable for each group in one comprehensive notice plan. Notices were designed and placed in media on a statewide basis and accurately informed each group of class members about their rights and options and the benefits available to them. Prior to final approval, our experts prepared a detailed final report affidavit describing what was done and why we believed the campaign was effective in reaching 80% of the class. Our experts also appeared and testified at the final approval hearing, overcoming several objections from class members. The Court overruled the objections and ultimately granted final approval to the settlement. Judicial Comments
