Judge Edgar E. Bayley, Dimitrios v. CVS, Inc., No. 99-6209; Walker v. Rite Aid Corporation, No. 99-6210; and Myers v. Rite Aid Corporation, No. 01-2771, (November 27, 2002) (Common Pleas Ct. PA):
"The Court specifically finds that: fair and adequate notice has been given to the class, which comports with due process of law."
Myers v. Rite Aid, Dimitrious v. CVS and Walker v. Rite Aid, also known as the PA Act 6 Cases, involved statewide claims against two of Pennsylvania's largest pharmacies regarding billing practices for medication needed as a result of a motor vehicle accident .
Hilsoft designed and implemented an extensive notice campaign that utilized daily newspapers throughout the state of Pennsylvania-that reached class members in both small towns and large cities. The extensive coverage of the notice activities allowed class members in every county several opportunities to learn about the case and their rights and options.
Hilsoft then studied and quantified the resulting reach of the notice to the class through an in-depth analysis, utilizing research tools and data trusted by the nation's largest advertising agencies media departments. Hilsoft's conservative methodologies and calculations yielded an effective reach among the class. Proprietary tools and techniques also allow Hilsoft to calculate the reach of statewide campaigns, including newspaper campaigns. Other vendors do not have this capability.
