Scott v. American Tobacco

In Scott v. American Tobacco, a class of smokers in Louisiana was certified for trial. Hilsoft Notifications designed notice plans to reach smokers. In preparing the plan, we scrutinized the availability of ‘marketing’ lists held by the tobacco companies, but advised that an effective media plan could reach the class.

The notice program faced opposition from an expert who argued the need for mailings to the wasteful and inaccurate lists. However, the Court rejected the use of such mailings. This objector would have increased the budget by approximately $1 million, however, Hilsoft Notifications helped fight off the objection. At this same time, despite the opposition, Hilsoft Notifications wrote, designed, and produced the notices stipulated to by the parties and approved by the Special Master, including addressing and incorporating his and the Court’s valuable input on the materials and the notice program. The notices ensured effective communication with class members.

Hilsoft Notifications successfully executed the notice plan informing the class members of their rights leading up to a trial. The notice program included notices in English and Spanish and used print notice in newspapers and consumer magazines, courthouse notice, television notice, press activities, and Internet efforts, including a website and telephone response system designed and hosted by Hilsoft Notifications. Hilsoft Notifications also coordinated with the Special Master on responses to be channeled to him.
