West v. G&H Seed Co.

    

In West v. G.H. Seed & Rhone-Poulenc, Louisiana crawfish farmers needed to be informed of the certification of a class action lawsuit involving rice treated with the pesticide ICON.  Hilsoft Notifications was asked to design and implement a notice program and undertake extensive analyses of the class, using a methodical process of assessing common characteristics along with knowledge of how to assess demographic data sources and cross-tabulate data with media and notice exposure data.  Having met with the farmers to gain a specific understanding of how to best reach them and through which media, the target-specific notice program that focused notice on class members, through both newspapers and radio notices, assured that none were strategically excluded.  Hilsoft Notifications’ radio notice plan was carefully selected to find the appropriate stations for the audience of rice/crawfish farmers and the radio notice was produced locally to ensure a voice that class members would identify with.

Shortly after the implementation of the class certification notice program, the parties reached a $45 million settlement.  Again, Hilsoft Notifications was relied upon to design, develop, and implement a notice program that would strategically reach a substantial percentage of class members.  Like the class certification notice program, Hilsoft Notifications proved that the settlement notice program effectively and efficiently reached a substantial percentage of class members who were eligible for benefits.  The Court approved the notice and dismissed the objections at the conclusion of the hearing.
