In re Royal Ahold Securities and "ERISA" Litigation, MDL No. 1539 (D. Md.) - Designed and oversaw the entire implementation of the securities litigation global notification program, which was the first to document the "reach" of notice among shareholders. Providing evidence that more than 85% of shareholders were reached with notice not only in the US, but in the Netherlands—where shareholders were predominantly located—and also showing that high percentages were reached in the other key shareholding countries, we planned and created a vigorous nominee and broker notice mailing plan. We then combined the measured success of that effort with a modern-style media program targeting beneficial holders of Ahold stock and ADRs. Judicial Comments
In re Parmalat Securities, MDL No. 1653 (LAK) (S.D. N.Y.) - In the wake of the financial collapse of the Italian giant Parmalat, a massive class action in the United States sought global certification of a class of shareholders and bondholders. Hilsoft Notifications was called upon to demonstrate manageability of notice to the worldwide class through a detailed expert affidavit. Later, when a partial settlement with two Parmalat securities issuing banks was proposed, we were asked to develop and oversee the implementation of a comprehensive notification program. This called for noticeable, plain language notices to be disseminated through a massive, multi-language mailing and publication effort, together with a global news release effort and multilingual website.
